By accessing and using this Site, you accept and agree to be bound by these Terms and our Privacy Policy, incorporated here by reference. These Terms apply to all visitors, users, and others who access or use the Site.
BayBix is a digital services agency that provides website design and management, online booking system setup, domain registration, business email configuration, Google Business Profile management, and automated SMS communication services to automotive service businesses. Our services are provided on a subscription basis under separate service agreements with each client.
The Site itself is a marketing and lead-generation website. Submitting a demo request form does not constitute a binding service agreement. A formal service agreement will be provided separately upon mutual agreement of terms.
The Site and its original content, features, and functionality — including but not limited to text, graphics, logos, and software — are and will remain the exclusive property of BayBix. Our content may not be reproduced, distributed, modified, or used for any commercial purpose without our prior written consent.
Websites, logos, and materials created by BayBix on behalf of clients remain the property of BayBix until full payment has been received and a written transfer of ownership has been executed. Upon completion of such transfer, the client owns all deliverables specific to their business.

When you submit a demo request or contact form on our Site, you consent to being contacted by BayBix via the contact information you provide, including by phone, email, or SMS. This consent is not a condition of any purchase. You may opt out of further communications at any time by contacting us at service@baybix.com or by replying STOP to any SMS message.
BayBix and its clients use SMS messaging for appointment reminders, review requests, and promotional communications. By providing a phone number through any BayBix-powered website or form, you consent to receive SMS messages from that business. Message and data rates may apply. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
BAYBIX DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. BAYBIX MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE'S CONTENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAYBIX, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR OUR SERVICES.
IN NO EVENT SHALL BAYBIX'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS PAID BY YOU TO BAYBIX IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless BayBix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States. We reserve the right to modify these Terms at any time. We will indicate the date these Terms were last revised at the top of the page. Your continued use of the Site following the posting of revised Terms means you accept and agree to the changes.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BayBix regarding your use of the Site and supersede all prior agreements and understandings.
